Terms of service

By using the PerkAround app or this website you agree to these terms. If you are accepting them for a restaurant, you confirm you are authorised to act for that business.

What PerkAround is

PerkAround is a place where restaurants publish their own offers and diners find them. We are not the restaurant. We do not cook the food, set the offer, take your order or process your bill. The agreement to honour an offer is between you and the venue.

For diners

• Using PerkAround to find and redeem offers is free.
• You need an account to redeem, and the phone number on it must be one you control.
• A redemption code is issued to you for one offer. Do not share, sell or reproduce it. Codes expire quickly and are checked at the point of scanning.
• The terms of an offer — the days it runs, what you have to buy, any limit on how often you can use it — are set by the restaurant and shown before you redeem. Read them.
• A restaurant can pause or end an offer at any time, and an offer can run out. We cannot guarantee that something you saw yesterday is still available today.

For restaurants

• You must be a real, operating food business and pass our verification before you can publish.
• You are responsible for every offer you publish: that it is accurate, that it is legal where you trade, that you can honour it, and that you have the right to use any image you upload.
• You must honour a valid redemption. If a code scans as valid inside the rules you set, the diner gets the offer. Repeatedly refusing valid redemptions is grounds for removal.
• Fees are $3 per month plus $0.15 per confirmed redemption, taken from your prepaid balance. If the balance cannot cover the fee, your offers stop being shown until it is topped up.
• Staff logins you create are your responsibility. Remove them when someone leaves.
• You can end your subscription at any time. Fees already incurred are not refundable, and any offers live at the time will stop being shown.

Things you must not do

• Create accounts to generate or redeem codes fraudulently.
• Interfere with the service, or try to access data that is not yours.
• Upload anything unlawful, misleading, or that you do not have the rights to.
• Scrape the service or resell access to it.

Suspending accounts

We can suspend or close an account that breaks these terms, is being used fraudulently, or is putting other people at risk. Where it is reasonable to do so, we will tell you why.

Availability

We work to keep PerkAround running, but we do not promise it will be available without interruption. Features change, and coverage varies by area.

Liability

PerkAround is not responsible for the quality, safety or legality of food, service or anything else provided by a restaurant, nor for a restaurant’s refusal to honour an offer. Disputes about a meal are between you and the venue — though we do want to hear about it, because a venue that will not honour its own offers should not be listed. To the fullest extent the law allows, our liability to you is limited to the amount you have paid us in the twelve months before the claim.

Changes

We may update these terms. If a change materially affects you we will give notice in the app. Continuing to use PerkAround after a change means you accept it.
